Presentation of the book “Good, Clean and Fair”

On March 16  the presentation of the book translated in Bulgarian Language “Good, Clean and Fair”, the basics of Slow Food’s philosophy, was presented at the Vivacom Hall in Sofia.

Publishing house Janet 45  and representatives of the Slow Food Bulgaria organized the event inviting the Italian gourmet and journalist Carlo Petrini.

The author is a promoter of the sustainable food system. In 1986, some of his friend and himself prepared spaghetti, distributing them to people passing by Piazza di Spagna in Rome, a gesture of protest against the first opening of McDonald’s in Italy. “Good, Clean and Fair” is his book-manifest, which has brought satisfaction to the gourmet author who was able to create a brand of international interest, following the philosophy of slowness and luxury to live the meal as pleasure. During the presentation, the author talked about food and food issues today, claiming that everything is part of the gastronomy and inviting the population to a greater awareness of food: its origin and the way it should be produced.

Another gastronomy conquest was the University of Gastronomic Sciences, founded in 2004, and promoted by the Slow Food International Association, chaired by Carlo Petrini. In the University, more than 600 students from 80 different countries are enrolled, the author reported. Italian Chamber of Commerce in Bulgaria attended the event.

Italian excellence does not only revolve around the fashion, design, and perhaps the world’s most famous food and wine industry. Italy is more. It is the production of technological goods, in aerospace innovation, holds the first position in pharmaceutical exports or in the field of mechanical engineering.

This is the message of the video “Italy the Extraordinary Commonplace“, presented by the Deputy Minister of Economic Development, Carlo Calenda, during Word Economic Forum in Davos.

ARBITRATION

The modern world has long discovered the benefits of alternative dispute resolution – arbitration. From an historical point of view, arbitration proceeds to ordinary justice. It is an appropriate tool, an alternative to the ordinary justice of the state, which is nowadays slower and more expensive all over the world, and especially in Bulgaria. The lack of speed and the high costs do not match the needs of the business, which needs a fast and economical method and less economical weight.

Italian Chamber of Commerce in Bulgaria is pleased to inform you of the newly established arbitration at the “European Institution for mediation and arbitration” (abbreviated EIMA in Bulgarian). The body represents an adequate response to the new demands of justice, following the example of the best legal practice in the European Union. The arbitrary award passed by EIMA is applicable in Bulgaria, in all EU Member States and in States acceding to the 1958 New York Convention (the Convention for the Recognition and Enforcement of Foreign Judgments).

The ADVANTAGES of the arbitration proceedings are:

  1. Quickness – arbitration procedures take place in a single instance, the arbitration award produces the same effects as a judgment issued by the court and the decision can not be challenged, so the award could be put into effect immediately
  2. Less appeals – arbitration is more rapid. Arbitration institutes are less likely to appeal than those reported to the state courts. The scheduling of the arbitration process respects the needs of the case and not the organization’s agenda.
  3. Costs less – The amount of tax is usually less than the 4% required to initiate an ordinary first instance procedure and a subsequent 4% fee for the following instances. It is very important that expenses for defenders, experts, interpreters and so on. Are carried out at an entity.
  4. Arbitration is confidential – the fact that disputes are made public in an ordinary process often lead to deterioration in the relationship between the two parties and the breakdown of business relationships. While resolving disputes through arbitration offers better opportunities to preserve good practice between the parties, which are the only ones to have access to documents relating to arbitration
  5. The parties indicate the arbitrators – the referee’s or arbitrators’ indication may be made in the contract, alongside the choice of the arbitration body.
  6.  The Parties choose the procedure – this means that the Parties may choose whether the arbitrators will have to decide on the legal rules applied under the EIMA Regulation or in accordance with other rules of order, in the case of better compatibility with the requirements of the case. Changes could also be made during the arbitration procedure.
  7. Execution abroad – the arbitration award is recognized and is subject to execution abroad. Recognition and enforcement of judgments abroad is subject to the procedural rules of each country.
  8. Judicial review by the Supreme Court – arbitration awards may be challenged before the Supreme Court if the following conditions are met: – no arbitration clause or falsification of the clause – the subject of disputes did not fall within the jurisdiction of the arbitration – the subject-matter of the disputes is not uniform to the public order of the Republic of Bulgaria – irregularities in the conduct of arbitration proceedings Out of the Arbitration Skills: • real property rights or real rights; • Labor disputes and food-related disputes • litigation related to public law, concerning the validity or breach of administrative acts. Reasons for EIMA’s arbitration The arbitral tribunal shall settle the dispute when an arbitration agreement is reached or one of the parties requests that it be resolved by AC EIMA and the other party does not oppose it, within the deadline for the reply.

At this time, the arbitration procedure applies mainly to private law and, above all, in the context of trade disputes.

Arbitration finds its legislative framework in Bulgaria in the International Trade Arbitration Act (ZMTA), the Code of Civil Procedure (GPK) and so on. In our country, arbitration arises with two arbitrary institutions, first established since the 1989 transition.

Today, there is a choice between several bodies, assessing the quality of the referees and experts and the ability to ensure execution Of arbitration on time and according to needs. The Arbitration College at the Arbitral Tribunal at EIMA is a group of independent, impartial and valid arbiters and experts, with extensive work experience and good reputation in professional circles and in society.
